Terms and Conditions
§ 1 Scope and contracting party
(1) These General Terms and Conditions apply to all orders you place via our online shop www.cellephone.de.
(2) Your contracting party is cellePhone e.K., owner Anton Fischer, Blaues Land 7a, 29229 Celle, Germany, registered in the commercial register of the Lüneburg Local Court under HRA 201249, phone +49 5141 9662767, e-mail info@cellephone.de.
(3) A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB).
§ 2 Conclusion of the contract
(1) The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.
(2) The ordering process consists of the following steps:
- You add the desired products to the shopping cart.
- In the shopping cart you check your selection and can change quantities or remove products.
- You enter your billing and delivery address and choose the shipping method.
- You choose the payment method and see all details of your order once more in an overview.
- By clicking the “Buy” button you submit a binding offer to purchase the products in your shopping cart.
(3) Until you click “Buy”, you can correct your entries at any time: quantities and products in the shopping cart, addresses via the edit buttons in the checkout, and any entry via the back function of your browser.
(4) We confirm receipt of your order by e-mail. We accept your offer as follows:
- If you pay with PayPal, credit card or another payment method that is processed immediately, the contract is concluded as soon as the payment has been successfully initiated; you will then receive the order confirmation by e-mail.
- If you pay in advance by bank transfer, we accept your offer by sending you our bank details by e-mail and asking you to pay.
(5) We store the text of the contract. We send you the order details, these General Terms and Conditions and the information on the right of withdrawal by e-mail together with the confirmation. If you have created a customer account, you can view your orders there at any time. The current terms can always be found on this page.
(6) The contract can be concluded in German, English, French, Italian, Spanish or Dutch.
§ 3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT. For deliveries to another member state of the European Union, the VAT applicable there is included.
(2) Shipping costs may be charged in addition to the purchase price. They are shown in the shopping cart and before you submit your order. An overview can be found on the page Shipping costs.
§ 4 Payment
(1) The payment methods available to you are shown in the checkout before you submit your order. In particular, we offer:
- PayPal: you are redirected to PayPal and confirm the payment there.
- Credit card and other payment methods via our payment service provider Mollie: you enter your payment details on a Mollie page; your account is charged after the order has been completed.
- Payment in advance by bank transfer: you transfer the invoice amount to our account; you will receive the bank details by e-mail after placing your order. We ship the goods once payment has been received.
(2) The purchase price is due upon conclusion of the contract.
§ 5 Delivery
(1) We deliver to the delivery address you specify within Germany and to all member states of the European Union. We ship with Deutsche Post, DHL or UPS.
(2) The delivery time is stated on the respective product page. For payment in advance it begins on the day after you instruct your bank to make the transfer, for all other payment methods on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
(3) If not all products ordered are in stock, we may make partial deliveries where this is reasonable for you; this does not incur any additional shipping costs for you.
§ 6 Retention of title
The goods remain our property until they have been paid for in full.
§ 7 Right of withdrawal
As a consumer you have a statutory right of withdrawal. The details and the model withdrawal form can be found in our information on the right of withdrawal.

§ 8 Warranty
(1) The statutory liability for defects applies.
(2) If products are delivered with obvious transport damage, please report such damage to the delivery driver immediately if possible and contact us. Failure to do so has no consequences whatsoever for your statutory rights, but it helps us to assert our own claims against the carrier.
§ 9 Information on batteries
(1) Batteries and rechargeable batteries must not be disposed of with household waste. As an end user you are legally obliged to return used batteries. You can hand them in at a municipal collection point or at a retailer.
(2) As a distributor, we take back free of charge used batteries of the type that we sell or have sold as new batteries. You can send them to us with sufficient postage or hand them in at our shipping warehouse: cellePhone e.K., Blaues Land 7a, 29229 Celle, Germany.
(3) The crossed-out wheeled bin symbol means that batteries must not be disposed of with household waste. If “Cd”, “Pb” or “Hg” appears below it, the battery contains more than 0.002 per cent by mass of cadmium, more than 0.004 per cent by mass of lead or more than 0.0005 per cent by mass of mercury.

§ 11 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection granted by the mandatory provisions of the law of the state in which you have your habitual residence.
